Un directeur de publication inculpé et écroué pour “diffamation” et “outrage à la justice”
Reporters sans frontières proteste contre l’arrestation, le 26 février 2008, d’Aboubacar Gourouza, directeur de publication du bimensuel indépendant L’Eveil Plus, par la police judiciaire à Niamey. Présenté devant la cour le 28 février, il a été inculpé de “diffamation” et d’”outrage à la justice”, puis écroué à la prison civile de Niamey, après que deux plaintes avaient été déposées contre lui.
”Aboubacar Gourouza est le cinquième journaliste incarcéré depuis l’arrestation de Moussa Kaka, le correspondant de Radio France Internationale (RFI) et de Reporters sans frontières, en septembre 2007, sans parler des nombreuses autres atteintes à la liberté de la presse qui ont été perpétrées. La direction dangereuse qu’a empruntée le Niger nous préoccupe fortement. Nous appelons les autorités nigériennes à libérer notre confrère et Moussa Kaka sans délai”, a déclaré l’organisation.
Le 26 février 2008, Aboubacar Gourouza a été interpellé, placé en garde à vue à la police judicidaire de Niamey, puis placé sous mandat de dépôt le 27 février à la prison civile de la ville, a indiqué à l’Agence France-Presse (AFP) son avocat, Me Moussa Zakaria. Cette incarcération survient après la parution, le 29 janvier 2008, de deux articles dans le bimensuel.
Le premier, intitulé “Le complot et les comploteurs démasqués”, accusait Moussa Keita, homme politique et ancien militant du Mouvement national pour la société de développement (MNSD-Nassara), d’avoir “orchestré” une vaste “machination” pour obtenir l’inculpation de Hama Amadou, ancien Premier ministre. Moussa Keita avait accusé Hama Amadou de complicité dans l’incendie de son véhicule. L’homme politique a porté plainte pour diffamation.
Le deuxième article, intitulé “Affaire Communauté urbaine de Niamey (CUN) : un autre complot contre le MNSD”, dénonçait le maintien en détention du président de la CUN, Aboubacar Seydou Ganda, “sans qu’on ne lui prouve la véracité des charges qui [pesaient] sur lui”. Le journaliste ajoutait que lui et “tous ceux qui [étaient] impliqués dans cette affaire et qui [croupissaient] encore en prison [devaient] être mis en liberté provisoire en attendant leur procès”. Il concluait qu’il y avait tout lieu de croire que “cette affaire [n'était] pas judiciaire mais politique”. Le procureur de la République a porté plainte pour “outrage à la justice”.
Le 28 février, Aboubacar Gourouza a été présenté au parquet du tribunal de grande instance de Niamey. Son procès a été renvoyé au 3 mars 2008. Moussa Kaka est toujours incarcéré à la prison civile de Niamey pour “complicité d’atteinte contre l’autorité de l’Etat”. Il risque la prison à vie.

Editor charged and held in custody for defamation and “contempt of justice”
Reporters Without Borders today protested at the arrest two days ago of Aboubacar Gourouza, editor of the independent bi-monthly L’Eveil Plus, by judicial police in Niamey in connection with two articles, one relating to an alleged plot against the former prime minister.
He was brought to court today, after being held by Niamey police, charged with “defamation” and “contempt of justice” and taken to the civil prison in the capital.
“Aboubacar Gourouza is the fifth journalist to be imprisoned since the arrest in September 2007 of Moussa Kaka, correspondent for Radio France Internationale (RFI) and Reporters Without Borders, without referring to numerous other press freedom violations that have been perpetrated”, the worldwide press freedom organisation said.
“We are extremely concerned about the dangerous course that Niger has embarked on. We urge the Niger authorities to immediately release our colleague and Moussa Kaka”.
Both articles appeared in the L’Eveil Plus on 29 January 2008. The first, headlined, “The plot and the plotters unmasked”, accused politician Moussa Keita, former activist in the National Movement for a Developing Society-Nassara (MNSD-Nassara), of “orchestrating” a major “conspiracy” to secure charges against former prime minister, Hama Amadou. Keita accused Hama Amadou of complicity in the torching of his own car and the politician had sued him for defamation.
The second article, headlined “the Niamey Urban Community (CUN) case : another plot against the MNSD”, criticised the detention of the president of the CUN, Aboubacar Seydou Ganda, “without any evidence of the truth of the charges against him”.The journalist added that he and “all those implicated in this case and who are still in prison should be given bail while awaiting trial”.
He concluded that there was reason to believe that “this case is not judicial but political”. The public prosecutor brought a case against him for “contempt of justice”.
Gourouza’s trial has been set for 3 March 2008. Moussa Kaka is still being held in prison in Niamey for “complicity in damaging state authority” and faces life imprisonment.
